Right to Internet : A Fundamental Right???
Fundamental Right is the basic human right of citizens. the Indian constitution grantees every Indian fundamental right. But today more than the guarantee of any other right people need insurance that they can access the internet anywhere and everywhere without facing restriction. Imagine a person who does not have digital freedom in digital India.
We often debate the pros and cons of the use of the internet and social media but we all are aware of the importance of them in our life. If there was no internet how could we have used our right to speech and expression, internet is the biggest platform for getting information and knowledge.
In the case of Feheema Shirin.R.K. v. State Of Kerala where students who lived in the hostel were not allowed to use mobile phone from 10 pm to 6 am. The student in the girls' hostel were also not allowed to use a laptop. This was a violation of fundamental right.
Freedom of right to speech and expression is a fundamental right and no body can deny any person his / her freedom. This is a basic human right which mankind gets from the time of birth. though internet we can express our idea and our message, it is medium to speak and express our thoughts.
Internet does not only give us a platform to communicate, connect and express, it also provides us the opportunity to learn with various sources.
The Kerala High Court gave its verdict on the above case and stated that Right to access internet is Fundamental right of every citizen and can not be restricted on unreasonable grounds.
Any Fundamental right can be restricted on reasonable grounds, even the Right to Speech and Expression is limited.
